The Designer Hire – Terms & Conditions of Use

Welcome to The Designer Hire. These Terms & Conditions govern your use of our website and services and apply to all users including customers and registered vendors ("lenders"). By using our site or signing up as a lender or customer, you agree to these terms.

1. Consent

By accessing our website or using our services, you:

Explicitly or implicitly agree to these Terms & Conditions, either by clicking to accept or by using the website after seeing a clear notice.
Acknowledge that these Terms comply with the Australian Consumer Law (ACL), including:
- Honest representations of products and services
- Fair cancellation, refund and consumer rights policies
Accept that the language herein is clear, reasonable, and written for the average consumer.

2. Services Overview

The Designer Hire provides fashion rental services through an online platform connecting lenders (vendors) with customers who wish to rent designer clothing.

We do not own or sell garments unless otherwise specified. We facilitate rentals, try-ons, deliveries and returns, and provide optional insurance coverage to protect against minor damage.

3. Bookings, Payments & Hire Fees

All bookings are secured only upon full payment of the hire fee.
Our standard hire period is 4, 6 or 8 days unless stated otherwise.
Australia-wide express postage is $30, inclusive of return satchel and mailer bag.
Late returns will incur $20 per day late fees.

4. Optional Damage Protection

You may choose to add Optional Damage Insurance for $9.99, which covers:

Up to $50 worth of accidental minor damage (e.g. small pulls, minor stains).
Does not cover loss, theft, irreparable damage, or alterations.
Any damage exceeding $50 is billed to you at repair cost or full RRP if unrecoverable.

5. Try-On Policy

In-studio try-ons are available by appointment only. You must book garments and supply your event date at checkout.
Try-ons do not guarantee reservation. To secure a garment, you must place a hire booking.
A $20 try-on fee applies and will be credited if a hire is booked within 24 hours.
Postal try-ons are available for select items upon enquiry.
Customers are liable for any damage during try-ons.
24 hours’ notice is required to reschedule appointments.

6. Delivery, Shipping & Returns

Orders are shipped via Express Post (1–2 business days for major cities, 2–3 for rural).
Customers must post garments back at Australia Post (not a street box) by 3PM on the final day of hire.
Reuse the mailer and return label provided.
We are not liable for delays, losses, or stolen parcels once marked as delivered by Australia Post.

7. Refunds, Cancellations & Exchanges

Refunds:

No refunds are provided under any circumstances.

Cancellations:

Cancellations made 30 days or more before the hire date will be issued a store credit minus a $30 cancellation fee.
Cancellations made within 30 days of the hire date are not eligible for credit or refund.

Store Credit:

Credit notes are valid for 24 months (updated on 10 October 2024).
Once used, bookings made with credit notes are final (no further changes/cancellations).
Fit issues do not qualify for credit.

Exchanges:

You may exchange bookings 30+ days in advance with no $30 fee.
If the new garment is cheaper, the difference is credited.
If it is more expensive, the difference must be paid.

8. Lender Responsibilities

By signing up as a vendor/lender, you agree to:

List only authentic, good-condition garments with accurate photos and descriptions.
Include pre-paid return satchels with all bookings.
Ensure timely shipping and communication with renters.
Maintain garments to a professional standard between hires.

You may not:

List counterfeit items
Withhold bookings without valid reason
Discriminate or mislead customers in any way

9. Damage, Loss, and Theft Policy

Borrower Responsibilities:

Garments must be returned in original condition, excluding reasonable wear.
You are liable for:
- Irreparable damage
- Missing garments
- Replacement value up to the RRP
All damage must be reported to us prior to return.
The Designer Hire may mediate disputes based on photographic evidence, communication, and garment inspection.

10. Account Use & Conduct

You must:

Provide accurate personal details
Safeguard your account credentials
Not use the service to harass, impersonate, defraud, or bypass our platform
Not circumvent fees by transacting off-platform

We reserve the right to suspend or terminate accounts for misuse, late returns, excessive cancellations, or inappropriate behaviour toward staff or other users.

11. Intellectual Property & Content

All content, branding and design are the property of The Designer Hire.
Member-generated content must not infringe on intellectual property, be offensive, or violate Australian law.

12. Limitation of Liability

The Designer Hire is not liable for damages caused by third parties (e.g. postal carriers, lenders, borrowers).
We are not responsible for loss of income, emotional distress, or consequential damages.
Liability is limited to the hire fee paid by the customer.

13. Disputes & Jurisdiction

Any disputes will be governed by the laws of Queensland. We encourage customers to contact us for resolution before seeking legal action. Where appropriate, mediation may be offered.

14. Changes to Terms

We reserve the right to amend these Terms at any time. Updated Terms will be published on our website. Continued use of our services implies acceptance of any changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Credit card information is always encrypted during transfer over networks.

Prices for our products are subject to change without notice.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
